Mission
The mission of the Marine Corps Office of Special Trial Counsel (OSTC) is to provide expert, independent, and ethical representation of the United States in the investigation and prosecution of the covered offenses prescribed in Article 1(17) of the Uniform Code of Military Justice (UCMJ), and other offenses over which the OSTC exercises authority pursuant to Article 24a, UCMJ.

The National Capital Region Office of Special Trial Counsel (OSTC-NCR) is responsible for the execution of OSTC duties and responsibilities for those offenses over which the OSTC exercises authority and has not deferred, where the alleged covered offense is alleged to have been committed by an active duty service member stationed in Washington D.C., and the states of Virginia, West Virginia, Pennsylvania, Maryland, Delaware, New Jersey, New York, Rhode Island, Connecticut, Massachusetts, New Hampshire, Vermont, and Maine.
The OSTC-NCR is a part of the independent USMC OSTC which reports directly to the Secretary of the Navy
The OSTC has exclusive authority over the below covered offenses if committed after 27 December 2023. The OSTC may exercise discretionary authority over the below covered offenses if committed prior to 28 December 2023:
- ​Article 117a (crimes involving intimate visual images)
- Article 118 (murder)
- Article 119 (manslaughter)
- Article 119a (death or injury of an unborn child)
- Article 120 (rape and sexual assault)
- Article 120a (mails:deposit of obscene matter)
- Article 120b (sexual assault of a child)
- Article 120c (miscellaneous sex offenses)
- Article 125 (kidnapping)
- Article 128b (domestic violence)
- Article 130 (stalking)
- Article 132 (retaliation)
- Article 134 (child pornography)
Conspiracies, solicitations, or attempts to commit these covered offenses are also covered offenses themselves. Offenses related to a covered offense, and any other known offense allegedly committed by the same accused, may also be handled by the OSTC.
